But first, a second federal judge has ruled against enforcing a controversial new government ban on an abortion procedure. The ruling on "partial birth" abortion by a New York judge comes a day after a judge in Nebraska said the government ban doesn't apply to some doctors in his state. He ruled shortly after President Bush signed the bill into law. CNN's Dana Bash has more. |

Reporter: PROPONENTS SAY IT'S AN OVERDUE END TO A BRUTAL PRACTICE. OPPONENTS CALL IT A SLIPPERY SLOPE TOWARD OUTLAWING ALL ABORTION. ONCE GOVERNMENT IS IN THE DOOR, WHO KNOWS WHAT THEY'LL DO NEXT. Reporter: THREE LAWSUITS ARE ALREADY FILED IN FEDERAL COURT TO STOP IT. THE LAW IS UNCONSTITUTIONAL. Reporter: A NARROWLY DIVIDED SUPREME COURT OVERTURNED A SIMILAR NEBRASKA LAW THREE YEARS AGO, CALLING IT TOO VAGUE AND LACKING PROTECTION FOR A MOTHER'S HEALTH. WITH POTENTIAL SUPREME COURT VACANCIES LOOMING, BOTH SIDES IN THIS POLARIZING DEBATE ARE COUNTING ON THIS CASE TO GALVANIZE SUPPORTERS FOR THE PRESIDENTIAL ELECTION. WE HOPE THAT BY THE TIME THIS CASE GETS UP BEFORE THE U.S. SUPREME COURT, THERE WILL BE A SHIFT OF AT LEAST ONE VOTE AWAY FROM THAT EXTREME POSITION. THIS WILL BE A WAKE-UP CALL TO PRO-CHOICE AMERICANS THAT THEIR RIGHT TO CHOOSE IS NOT SAFE UNDER THIS PRESIDENT. Reporter: BUT A VAST MAJORITY OF AMERICANS SUPPORT THE BILL. THE LATEST CNN/GALLUP POLL SHOWS 77% OF 18- TO 29-YEAR-OLDS AND 68% 30 AND OVER THINK SUCH LATE-TERM OR PARTIAL BIRTH ABORTIONS SHOULD BE ILLEGAL. THOUGH ANTI-ABORTION GROUPS ADMIT THEY HOPE THIS BAN WILL OPEN THE DOOR TO OTHERS, THE PRESIDENT IS CAREFUL WITH HIS WORDS. I DON'T THINK THE CULTURE HAS CHANGED TO THE EXTENT THAT THE AMERICAN PEOPLE OR THE CONGRESS WOULD TOTALLY BAN ABORTION. |

The Democratic candidates seeking to win the NH Primary might want to pick up a new book that focuses on how their party has fared over the years in the First in the Nation primary. The book is called "Stormy Weather: The New Hampshire Primary and Presidential Politics." The author is Dante Scala, a political science professor at the Institute of Politics at St. Anselm's college, and a familiar face to Outlook viewers. I spoke to Dante on Wednesday about the book that David Broder of the Washington Post has called "a political junkie's dream." |

YOU KNOW, THERE'S BEEN A NUMBER OF BOOKS WRITTEN ABOUT THE PRIMARY OVER THE YEARS. WHAT WAS YOUR APPROACH? MY APPROACH STARTED WITH THE QUESTION, WHAT DOES IT TAKE TO WIN THE NEW HAMPSHIRE PRIOR MATTER? I TOOK TWO DIFFERENT CUTS AT IT. ONE WAS ANALYSIS OF THE DEMOGRAPHICS. FOR THIS I FOCUSED ON THE DEMOCRATIC PRIMARIES GOING ALL THE WAY BACK TO 1968. LYNDON JOHNSON AND GENE McCARTHY AND CARRYING IT FORWARD ALL THE WAY TO 2000. I LOOKED AT HOW THE DEMOCRATIC PARTY AND ITS VOTERS HAVE CHANGED DEMOGRAPHICALLY. HOW THEY'VE BECOME MORE UPSCALE, MORE ELITE, LESS WORKING CLASS. AND HOW THAT HAS AFFECTED THE CANDIDATES WHEN THEY COME UP HERE AND WHY DIFFERENT CANDIDATES ARE DOING BETTER NOW THAN THEY WERE, SAY, THREE DECADES AGO. YOU'RE SAYING THEN THAT THE POPULOUS HERE OF DEMOCRATS WHO WOULD VOTE HAS BECOME MORE LIBERAL AND THEREFORE YOU HAVE TO APPEAL MORE TO THEM. CERTAINLY THEY'VE BECOME MORE LIBERAL. THEY'VE BECOME MORE WHITE COLLAR. THEY'VE BECOME MORE PROFESSIONAL. IN THE MEANTIME THE MANUFACTURING CENTERS HAVE DECREASED IN POPULATION AND DECREASED IN VOTING STRENGTH. SO CERTAINLY THERE'S BEEN THIS TUG OF WAR THAT'S BEEN GOING ON TIME AND TIME AGAIN AND HENCE THE NAME OF THE BOOK STORMY WEATHER. IT'S PREDICTABLE. NEW HAMPSHIRE IS KNOWN FOR ITS UNPREDICTABILITY BUT IT'S ACTUALLY PREDICTABLE WHEN YOU HAVE THESE TWO FRONTS OR TWO FACTIONS OF DEMOCRATIC VOTERS, TRADITIONAL WORKING-CLASS PEOPLE VERSUS MORE LIBERAL, MORE ELITE WHO WILL MORE INTERESTED IN REFORM, WHEN THOSE TWO GROUPS GET TOGETHER YOU'RE GOING TO GET THE POLITICAL STORMS THAT WE SEE EVERY FOUR YEARS. WITH THAT CHANGING MIX OF DEMOCRATIC VOTERS IN THE STATE, DO YOU THINK AT THE BOTTOM OF SOME OF THE COMPLAINTS ABOUT OUR STATUS AS BEING THE FIRST IN THE NATION? I MEAN, I UNDERSTAND. SOME OTHER STATES SAY WE ARE NOT REPRESENTATIVE AND CERTAINLY IF WE ARE AN OVERLY LEFT-LEANING OR LIBERAL POPULOUS ON THE DEMOCRATIC SIDE, WOULDN'T THAT GIVE THEM AMMUNITION TO CHALLENGE OUR STATUS? I THINK WHAT MY BOOK DOES IS IT SHOWS-- AND THIS KIND OF LOOKS AT OTHER PEOPLE'S WORK AND MOVES IT FORWARD-- IS THAT NEW HAMPSHIRE GIVES A GOOD PICTURE OF HOW WORKING-CLASS DEMOCRATS FEEL. WHITE WORKING-CLASS DEMOCRATS AND HOW ELITES FEEL ABOUT DIFFERENT CANDIDATES. I THINK NEW HAMPSHIRE ACTUALLY WHEN YOU DIVIDE THE VOTE THAT WAY AND LOOK AT, SAY, HOW ELITE TOWNS LIKE DURHAM, LEE, PETERBOROUGH, HANOVER, HOW THEY VOTE AND THEN HOW WORKING CLASS AREAS LIKE PARTS OF MANCHESTER, ROCHESTER, SUMMERSWORTH. IF YOU LOOK AT HOW THEY VOTE THEY'RE ACTUALLY GOOD PREDICTORS OF HOW PEOPLE WHO ARE SIMILAR TO THEM IN SOCIOECONOMIC BACKGROUND IN FUTURE PRIMARIES ARE GOING TO VOTE. HISTORICALLY NEW HAMPSHIRE HAS ALWAYS BEEN THE PLACE WHERE A CANDIDATE REALLY HAS TO MAKE A STAND. ARE YOU SAYING THAT'S STILL THE CASE? I THINK THAT'S STILL THE CASE BECAUSE IT SHOWS QUITE EARLY HOW CANDIDATES ARE GOING TO FARE WITH THOSE TWO IMPORTANT FACTIONS WITHIN THE PARTY. YOU FIND A LOT OF BIG DIFFERENCES BETWEEN THE DIFFERENT PRIMARYS? '68 TO '72, '80? REALLY ALL SHARING SIMILAR DYNAMICS. CERTAINLY THERE'S THE CASE THAT THE PRIMARY HAS STARTED EARLIER AND EARLIER OVER TIME. WHAT IT TAKES TO RUN A GOOD INSURGENT CAMPAIGN HAS CHANGED OVER TIME. FOR INSTANCE, YOU GO BACK AS I DID TO TALK TO VETERANS OF GENE McCARTHY'S CAMPAIGN IN 1968. THAT HAD SOME OF THE ELEMENTS OF A TRUE INSURGENCY THAT CAME OUT OF NOWHERE. IT STARTED VERY, VERY LATE. JUST A COUPLE MONTHS. GET CLEAN FOR GENE. .JUST A COUPLE MONTHS BEFORE THE PRIMARY AND WAS REALLY THROWN TOGETHER AT THE LAST MINUTE. COMPARE THAT TO LATER DAY INSURGENCIES LIKE BILL BRADLEY AND HOWARD DEAN. THOSE WERE METICULOUSLY PLANNED AND VERY PROFESSIONAL. SO AS THE PRIMARY HAS GOTTEN AN EARLIER AND EARLIER START UP HERE, TO BE A TRUE INSURGENT YOU'VE HAD TO BE IN SOME WAYS ADOPTING MORE PROFESSIONAL TECHNIQUES THAN THE OLD DAYS. WHEN I LOOK AT THE SUCCESS OF BILL CLINTON, WE TEND TO FORGET THAT BILL CLINTON IN '92 DIDN'T ACTUALLY WIN THE NEW HAMPSHIRE PRIMARY BUT HE WAS SUCCESSFUL AT LABELING HIMSELF AS THE COMEBACK KID AND, WELL, THE REST IS HISTORY. I THINK THAT'S WHAT I WOULD CALL ONE OF THE MYTHIC ELEMENTS OF NEW HAMPSHIRE IS THAT PAUL ZONGAS WAS ROBBED OF HIS VICTORY BY A SLICK BILL CLINTON WHO STOLE THE LIMELIGHT FROM HIM. MY ARGUMENT IN THE BOOK IS THAT IF YOU LOOK AT THE DEMOGRAPHICS OF BILL CLINTON'S VOTE, HE HAD VERY GOOD REASON TO BE HAPPY THAT NIGHT BECAUSE HE SHOWED MUCH MORE POTENTIAL TO BUILD A COALITION OF WORKING-CLASS VOTERS AND ELITE VOTERS THAN PAUL ZONGAS. HE GOT MOST OF HIS VOTES FROM THE ELITE AREAS OF NEW HAMPSHIRE. HE REACHED. REALLY REACHED ITS CEILING IN NEW HAMPSHIRE WHEREAS BILL CLINTON HAD MUCH MORE ROOM FOR GROWTH. AS WE SAW, OF COURSE, IN THE PRIMARIES THAT THEN FOLLOWED, ONE OF THE OTHER INTERESTING THINGS THAT HAPPENED LAST TIME AROUND WAS WITH BILL BRADLEY. HERE WAS A MAN WHO GOT WITHIN FOUR POINTS OF A SITTING VICE PRESIDENT AND YET IT SEEMED AS THOUGH HE HAD LOST-- NOT JUST CAME A CLOSE SECOND BUT ACTUALLY LOST; AND AFTER THAT HIS CAMPAIGN JUST SEEMED TO GO NOWHERE. CERTAINLY 2000 PRIMARY SO INTERESTING BECAUSE YOU HAD VICE PRESIDENT AL GORE. I DON'T THINK EVER HAS A WINNING CAMPAIGN IN NEW HAMPSHIRE BEEN SO HEAVILY AND BROADLY CRITICIZED BY ALMOST EVERYONE I TALKED TO, ALL THE ACTIVISTS, THE JOURNALISTS AND SO FORTH. EVERYONE HAD BAD THINGS TO SAY ABOUT THE GORE CAMPAIGN WITH FEW EXCEPTIONS. YET THE GORE CAMPAIGN STUCK IT OUT. THEY WERE REALLY. THEY GROUNDED OUT AND BEAT BILL BRADLEY HERE IN NEW HAMPSHIRE. THEN AS YOU SAY, BRADLEY DIDN'T HAVE MUCH ELSE TO GO. I THINK THAT'S BECAUSE AGAIN LOOKING AT THE DEMOGRAPHICS OF THE BRADLEY VOTE, BILL BRADLEY'S VOTE LOOKED AN AWFUL LOT LIKE PAUL ZONGAS' VOTE. THEREFORE, BRADLEY HAD NOWHERE TO GO WHEREAS GORE HAD PAINSTAKINGLY MANAGED TO BUILD A COALITION OF VOTERS. BY THE DEMOGRAPHICS YOU MEAN YOUR STUDY OF HOW PEOPLE IDENTIFY THEMSELVES WHETHER IT BE WORKING CLASS OR UPPER CLASS, THINGS LIKE THAT? ACTUALLY WHAT I LOOKED AT WERE TOWNS AND CITY WARDS IN NEW HAMPSHIRE. I LOOKED AT THE CENSUS DEMOGRAPHICS TO LOOK AT THINGS LIKE COLLEGE EDUCATION, INCOME AND PROFESSIONAL STATUS. SO I BASICALLY SCREENED OUT PLACES IN NEW HAMPSHIRE THAT ARE STILL WORKING CLASS VERSUS AREAS THAT ARE CLEARLY IN UPPER MIDDLE CLASS OR ABOVE. YOU TALKED TO A LOT OF PEOPLE IN RESEARCHING THIS BOOK. YOU MUST HAVE GOTTEN SOME GOOD STORIES FROM SOME OF THEM. JUST TERRIFIC STORIES, NOTHING THAT NEW HAMPSHIRE POLITICIANS ESPECIALLY DEMOCRATIC POLITICIANS LIKE TO DO THAN TALK ABOUT WAR STORIES. I WENT BACK AND TALKED TO THE AD MAN FOR GENE McCARTHY IN 1968, MERV WESTIN, TALKED TO CATHERINE ROGERS WHOSE FIRST CAMPAIGN WAS JIMMY CARTER'S AND THEN WORKED FOR WALTER MONDALE. SHE WAS THE ONE WHO HAD DELIVER BAD NEWS TO MONDALE DURING THAT LAST WEEK BEFORE THE PRIMARY ON A COUPLE OF OCCASIONS. TALKED TO JEANNE SHAHEEN AND BILL SHAHEEN WHO AGAIN THEIR FIRST CAMPAIGN WAS JIMMY CARTER'S. IN FACT, A LOT OF THE STARS OF THE STATE DEMOCRATIC PARTY CUT THEIR TEETH ON JIMMY CARTER'S CAMPAIGN. SO A LOT OF GOOD STORIES. CLEARLY THEY BUILT VERY INTERESTING CAREERS. JEANNE SHAHEEN WAS MENTIONED AT ONE POINT AS A POSSIBLE VICE PRESIDENTIAL CANDIDATE FOR AL GORE. CLEARLY THE PRIMARY IS IMPORTANT FOR A NUMBER OF REASONS. DO YOU THINK THAT YOU HAVE FOUND COMPELLING ENOUGH REASONS TO CONVINCE THE REST OF THE NATION OR AT LEAST THE DEMOCRATIC PARTY ADVOCATES CAN USE THOSE ARGUMENTS TO CONVINCE THE REST OF THE NATION THAT THIS SHOULD REMAIN FIRST IN THE NATION? THERE ARE TWO COMPELLING REASONS FOR NEW HAMPSHIRE. ONE THAT WE TAKE CIVIC PARTICIPATION AND VOTING SERIOUSLY IN THIS STATE. NOT ONLY DURING THE PRIMARY BUT ALSO DURING GENERAL ELECTIONS AND SO FORTH. AND THAT WE ARE TYPICALLY AMONG THE HIGHEST VOTING RATES IN THE NATION. SECONDLY, WE HAVE A TRULY LEVEL PLAYING FIELD IN NEW HAMPSHIRE. THERE IS A REAL ABSENCE OF ANY KIND OF POLITICAL MACHINE. AS ONE DEMOCRATIC ACTIVIST SAID TO ME, I WISH WE HAD A MACHINE. BUT THERE'S NO MACHINE LABOR UNIONS AREN'T ESPECIALLY STRONG. BEING FROM CHICAGO YOU KNOW MACHINES. EXACTLY. SO CANDIDATES REALLY HAVE A LEVEL PLAYING FIELD. SO AS ONE ACTIVIST SAID TO ME, ANYONE CAN PLAY IN NEW HAMPSHIRE. I THINK THAT'S ONE OF THE ENDURING ELEMENTS OF THE PRIMARY. AND A LONG-RUNNING STORY. THANK YOU VERY MUCH. GOOD LUCK WITH THE BOOK. THEREFORE, WHAT WE'VE GOT HERE IN NEW HAMPSHIRE TODAY, I BELIEVE, MUST EXCEED NEXT SUMMER AND NEXT NOVEMBER. THEREFORE, I WANT TO EXPRESS MY APPRECIATION TO YOU AND ASK YOU FOR YOUR SUPPORT IN THE PRIMARIES THIS MARCH. THANK YOU. STARTED BACK IN 1948 AND 1949 WHEN THEN SPEAKER OF THE HOUSE RICHARD UPTON DRAFTED NEW LEGISLATION FOR THE NEW HAMPSHIRE PRESIDENTIAL PRIMARY. RICHARD UPTON DECIDED THAT THERE HAD TO BE MORE ATTENTION AND FOCUS GIVEN TO THE PRIMARY AND ONE WAY TO DO THAT WAS TO MOVE FROM HAVING A NEW HAMPSHIRE VOTER VOTE FOR A DELEGATE, PLEDGED TO A PRESIDENTIAL CANDIDATE TO A DIRECT VOTE. THAT IS, YOU WALK INTO THE VOTING BOOTH IN 1952 FOR THE FIRST TIME, YOU CAST YOUR VOTE FOR A PRESIDENTIAL CANDIDATE. BY STATE LAW, NEW HAMPSHIRE IS REQUIRED TO HOLD ITS FIRST IN THE NATION PRIMARY ONE WEEK AHEAD OF ANY OTHER SIMILAR ELECTION IN THE COUNTRY. ONE OF THE MORE MEMORABLE MOMENTS IN NEW HAMPSHIRE PRESIDENTIAL PRIMARY HISTORY IS RONALD REAGAN'S REMARKS AT A DEBATE IN 1980. A DEBATE SUPPOSEDLY LIMITED TO REAGAN AND GEORGE BUSH, BUT BEFORE THE DEBATE GOT STARTED, THE EXCLUDED CANDIDATES, ALEXANDER, BAKER, CRANE AND DOLE TOOK TO THE STAGE ANYWAY. AND THAT ELICITED THIS NOW FAMOUS REMARK FROM GOVERNOR REAGAN. I AM PAYING FOR THIS MICROPHONE. ESSENTIALLY THIS MOMENT WAS BROADCAST NATIONWIDE AND CLEARLY SET RONALD REAGAN AHEAD OF HIS CLOSEST CONTENDER, GEORGE BUSH. Reporter: ANOTHER FAMOUS MOMENT IN NEW HAMPSHIRE PRESIDENTIAL PRIMARY HISTORY IS THIS EMOTIONAL SPEECH BY THEN DEMOCRATIC FRONTRUNNER MAINE SENATOR EDMUND MUSKIE OUTSIDE THE UNION LEADER WHOSE EDITORIAL PAGES HAD BEEN ATTACKING HIS CANDIDACY. THIS WAS A MOMENT WHERE THIS CANDIDATE HAD HAD ENOUGH, AND THERE WAS A QUESTION AS TO WHETHER HE HAD CRACKED. DID HE CRY? THERE'S STILL A QUESTION ABOUT THAT. NONETHELESS, THE IMAGE AND THE MOMENT REMAINS AS THE TIME THAT THE CANDIDATE BITTERLY ATTACKED THE NEWSPAPER AND BROKE DOWN IN THE PROCESS. THUS CALLING INTO QUESTION HIS CAPACITY FOR THE TOUGH DECISIONS OF THE PRESIDENCY. Reporter: THE EXHIBIT ALSO HIGHLIGHTS THE CONCEPT OF RETAIL POLITICS NEW HAMPSHIRE STYLE. THE CANDIDATE IS FORCED TO COME TO NEW HAMPSHIRE AND ANSWER QUESTIONS PUT TO THEM BY REAL VOTERS ABOUT REAL ISSUES. WHEN YOU'RE IN FRONT OF SOMEONE IN A LIVING ROOM OR A COUNTRY STORE OR OTHER NEW HAMPSHIRE STYLE CAMPAIGN EVENT, YOU NEED TO BE CONVERSANT WITH THE ISSUES THAT YOU'RE TALKING ABOUT. THIS IS THE PROVING GROUND FOR THAT. NEW HAMPSHIRE'S POLITICAL TRADITION REQUIRES A CANDIDATE TO GO FROM THE HIGH-TECH FACTORY IN THE SOUTHERN TIER OF THE STATE TO THE PAPER MILLS IN BERLIN AND THEIR LONG HISTORY TO EVERY SIZE INDUSTRY IN BETWEEN. IN TERMS OF REACHING OUT TO POTENTIAL VOTERS, NEW HAMPSHIRE HAD A SAYING THAT NEW HAMPSHIRE WAS ALWAYS FIRST, ALWAYS RIGHT IN PRESIDENTIAL SELECTION. BUT UNFORTUNATELY THE 1990s BROUGHT A CHANGE TO THAT. IN FACT, BILL CLINTON IN '92 DID NOT WIN THE NEW HAMPSHIRE PRIMARY. Reporter: BUT HE DID WIN THE PRESIDENCY. SO HOW ABOUT ALWAYS FIRST MOSTLY RIGHT? IN CONCORD, FOR NEW HAMPSHIRE OUTLOOK, I'M CHIP NEAL. |

On Wednesday, President Bush signed into law the first federal restriction on abortion rights since the Roe v. Wade decision thirty years ago. The new law bans the procedure known as partial-birth abortion, in which a fetus is brought partway into the birth canal and then aborted. Before signing the bill, the President summed up why supports it. |

The author is Dante Scala, a political science professor at the Institute of Politics at St. Anselm's college, and a familiar face to Outlook viewers.
